Bombay HC Bans New Construction In Mumbai City And Suburbs
The Bombay High Court has banned all new construction within the municipal limits of Mumbai city and suburbs up to Dahisar in the Western suburbs and Mulund in the Eastern suburbs
Ban is a result of the government having failed to take concrete steps for proper waste disposal under the Municipal Solid Waste (Management and Handling) rules at the Deonar and Mulund dumping grounds.
The ban, which becomes effective from today, does not include projects under redevelopment, slum rehabilitation, MHADA, hospitals and educational institutions.
Analysts say this development will not impede any ongoing projects where an intimation of disapproval (IOD) and commencement certificate (CC) have been issued
As most projects fall under the ambit of slum rehabilitation, redevelopment and MHADA with limited virgin land, a large number of projects would fall outside its ambit.
Analysts say upcoming phases in the ongoing projects of converted land parcels (from industrial & mill lands or residential & office) may see delays until the order is in place.
The new Development Plan for Mumbai, which has been in the works for some time and proposes higher density (FSI) in several areas, may require additional modifications until waste management issue is resolved
